Optemistix Terms of Service

These Terms of Service (“Terms”) govern your use of the Optemistix mobile application, website, ChatGPT plugin, and related Services provided by Optemistix, LLC.

By accessing or using Optemistix, you agree to these Terms.

If you do not agree, do not use the Services.

You must be at least 13 years old to use Optemistix.

By creating an account or using the Services, you represent that you meet the applicable age requirement and that information you provide is accurate.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify Optemistix promptly if you believe your account has been accessed or used without authorization.

You may delete your account at any time through: Profile → Settings → Delete Account or by contacting: admin@optemistix.com. 

Optemistix provides lifestyle and wellness-oriented tools and content that may include affirmations, encouragement, guided reflection, goal-setting support, motivational material, personal-growth content, and community features.

Optemistix content is provided for general informational, educational, motivational, and wellness purposes.

Optemistix does not provide medical, mental-health, psychiatric, legal, financial, or other licensed professional advice.

Optemistix should not be used as a substitute for professional diagnosis, treatment, counseling, emergency assistance, or another professional service.

If you are experiencing an emergency or believe you or someone else may be in immediate danger, contact emergency services or an appropriate qualified professional.

Certain Optemistix features may be accessible through third-party services, including ChatGPT.

Your use of ChatGPT or another third-party platform is also subject to that platform's applicable terms, policies, and privacy practices.

Optemistix does not control the availability, functionality, security, or continued operation of third-party platforms.

Features available through the Optemistix ChatGPT plugin may differ from features available in the Optemistix mobile application.

AI-generated or AI-assisted content may occasionally be incomplete, inaccurate, or inappropriate for a particular circumstance. You are responsible for exercising reasonable judgment when relying on generated content.

The Optemistix mobile application may offer optional paid subscriptions and one-time purchases.

Mobile payments are processed through the Apple App Store or Google Play and are subject to the applicable marketplace's terms and policies.

Subscriptions may renew automatically unless canceled in accordance with the applicable app marketplace's requirements.

Users are responsible for managing or canceling subscriptions through their Apple App Store or Google Play account settings where applicable.

Except where required by law or applicable marketplace policy, payments may be non-refundable.

Optemistix may include community features such as Groups, messaging, reactions, voice or video communications, and shared media.

You agree not to use Optemistix to create, upload, transmit, distribute, promote, or engage in content or conduct that is unlawful, threatening, harassing, hateful, abusive, exploitative, fraudulent, defamatory, infringing, malicious, or otherwise prohibited by applicable law or these Terms.

Optemistix may remove content, restrict functionality, suspend accounts, or terminate access when reasonably necessary to enforce these Terms, protect users, comply with law, or maintain the integrity and safety of the Services.

Where available, users may report or block other users through Optemistix.

You retain ownership of content you create and submit through Optemistix.

By submitting content to the Services, you grant Optemistix a limited, non-exclusive license to host, store, process, transmit, display, and otherwise use that content solely as reasonably necessary to operate, maintain, secure, and provide the Services.

You are responsible for content you choose to create or share and for ensuring that you have the necessary rights to provide that content.

The Optemistix name, logos, infinity symbol, branding, graphics, design, software, interfaces, text, original content, and other proprietary materials are owned by or licensed to Optemistix, LLC and are protected by applicable intellectual-property laws.

Except as permitted by law or with our written authorization, you may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit proprietary Optemistix materials.

Optemistix may modify, update, add, remove, suspend, or discontinue features as the Services evolve.

We do not guarantee that every feature will always be available or operate without interruption.

To the extent permitted by applicable law, the Services are provided “as is” and “as available.”

Optemistix makes no guarantee that the Services will always be uninterrupted, error-free, complete, accurate, or suitable for every user's individual circumstances.

To the maximum extent permitted by applicable law, Optemistix, LLC and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of or inability to use the Services.

Nothing in these Terms excludes liability that cannot legally be excluded.

You may stop using Optemistix and delete your account at any time.

Optemistix may suspend or terminate access when a user materially violates these Terms, abuses the Services, creates a security risk, violates applicable law, or threatens the rights or safety of Optemistix or others.

Use of the Services is also governed by the Privacy Policy contained on the Privacy Policy Optemistix webpage.

We may update these Terms from time to time as Optemistix evolves.

Material changes will be reflected by updating the “Last Updated” date at the top of this page.

Your continued use of Optemistix after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.
